  1. Legislation enacted by Congress in 2006 now requires the compliance statement to be on every page of the website.

 

  1. The statement above must be displayed on webpages in a font size that is no smaller than the second largest font used in the work or at least 12pt type and in a color that clearly contrasts with the background color.  28 CFR 75.6(e).

The regulations set forth at 28 CFR 75.8(d) allow for the display of the compliance on a separate page that is accessed by the clicking of a hypertext link that states exactly the following:  “18 U.S.C. 2257 record-Keeping Requirements Compliance Statement.”  However, since 28 CFR 75.8(d) pertains to compliance statement regulations that were less stringent than those recently enacted by Congress, as of May 1, 2007 it is uncertain whether the use of the hyperlink on every page would comply with the current statutory requirements.   The Department of Justice has indicated that it will issue new regulations to address several inconsistencies between the federal regulations promulgated by the Department of Justice at 18 CFR 75 et seq. and 18 U.S.C. §2257, the statutory source of the regulations.
